By accessing the Service, you agree to follow this AUP.
Prohibited Use
You will not, and will not permit any third party to:
Violate law. Use the Service in violation of any law, regulation, or third-party right, including TCPA, TSR, CAN-SPAM, FTC Act, state UDAP statutes, GDPR, CCPA, HIPAA, COPPA, FCRA, intellectual property, consumer protection, anti-discrimination, export control, sanctions, anti-corruption, or anti-money-laundering laws.
Contact without consent. Use the Service to contact, solicit, market to, profile, or capture data about any individual without the legally required consent, lawful basis, or required disclosures.
Operate on prohibited properties. Deploy the Service on properties operating illegal gambling, controlled-substance sales without proper licensure, sexual content involving minors, human trafficking, fraud schemes, unregistered securities offerings, “pig-butchering” or romance-scam funnels, or other illegal or deceptive activities.
Manipulate evidence. Falsify timestamps, identities, IP addresses, or other metadata; manufacture evidence of consent that was not freely given; alter, suppress, or destroy Consent Records in a manner inconsistent with their evidentiary purpose.
Reverse engineer. Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service, except where applicable law permits notwithstanding contractual prohibition.
Resell or rebrand. Resell, sublicense, white-label, or offer the Service as a standalone product to third parties without a written reseller agreement.
Disrupt the Service. Interfere with or disrupt the integrity or performance of the Service or the data contained therein, including by submitting malware, conducting denial-of-service attacks, scraping at abusive volume, or probing for vulnerabilities outside a sanctioned program.
Submit harmful content. Use the Service to generate, store, or transmit content that is unlawful, defamatory, harassing, infringing, deceptive, threatening, or that violates the rights of any person.
Compete deceptively. Use the Service to develop a competing product or to benchmark for competitive disclosure without prior written consent.
Impersonate. Impersonate any person or entity, including CapchaCloud personnel.
Process restricted data. Use the Service to Process PHI subject to HIPAA, cardholder data subject to PCI-DSS, government-classified information, or personal information of children under 13 (or 16 in the EEA) without an executed addendum (e.g., BAA for HIPAA).
Send unsolicited bulk communications. Use the Service to send unsolicited bulk email, SMS, voice, or other communications (“spam”) in violation of applicable law.
Misuse AI features. Use AI features to generate disinformation, deepfake content of real individuals without consent, harassment, or output represented as professional advice it is not.
Enforcement
CapchaCloud may investigate suspected violations and may suspend, throttle, downgrade, or terminate Accounts engaged in prohibited conduct, with or without prior notice depending on severity. Repeated or egregious violations may result in permanent termination and notification to law enforcement.
Reporting Abuse
Report suspected violations of this AUP to support@serviceautomations.ai with the subject line “Abuse report”. CapchaCloud will review reports and take appropriate action.
